1. Acceptance of Terms

By accessing or using the services provided by Red Bird Studios LLC (“Red Bird Studios,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree with any part of the Terms, you may not use our services.

2. Services

Red Bird Studios offers video production and related services, including but not limited to concept development, cinematography, video editing, and post-production. The scope of services and specific deliverables will be outlined in a separate proposal or contract.

3. Client Obligations

Provision of Materials: You agree to supply all necessary materials (scripts, logos, footage, etc.) in a timely manner to ensure project deadlines can be met.
Cooperation: You agree to provide feedback and approvals within a reasonable timeframe so that projects can progress without delay.

4. Intellectual Property

Ownership of Work: Unless otherwise stated in writing, Red Bird Studios retains ownership of all raw footage, project files, and intellectual property used or created during production.
License to Use: Upon final payment, you are granted a non-exclusive, non-transferable license to use the delivered, finalized video(s) for the agreed-upon purpose(s).

5. Payments

Fees and Invoicing: Payment details, including fees and schedules, will be outlined in a separate proposal or contract.
Late Payments: Late payments may incur interest or additional fees as stated in the proposal or contract.

6. Limitation of Liability

No Guarantee of Results: While we strive to produce the highest quality videos, we do not guarantee any specific outcomes or results from our services.
Damages: To the fullest extent permitted by law, Red Bird Studios is not liable for indirect, incidental, or consequential damages arising from the use of our services.

7. Modification of Terms

We reserve the right to revise or update these Terms at any time, with or without notice. The updated Terms will be effective immediately upon posting on our website. Continued use of our services after any modifications constitute acceptance of the revised Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Arizona, without regard to its conflict of law provisions.

Return and Refund Policy

1. No Refunds Once Production Begins or Is Delivered

Due to the creative and time-intensive nature of video production and editing services, no refunds will be issued for any videos that are:

Already delivered (in final or near-final form), or
In the process of being edited or created once production has begun.

2. Deposit and Payments

Deposit: A deposit may be required to secure your project’s start date and resources. This deposit is non-refundable once we commence pre-production and planning.
Progress Payments: Any agreed-upon milestones or progress payments must be made as outlined in your proposal or contract. These payments are likewise non-refundable once the corresponding work has been initiated or completed.

3. Cancellations

Before Production Begins: If you cancel prior to the start of any production or editing work, we may, at our discretion, offer a partial refund of any payments made, minus administrative or other fees.
After Production Begins: If you cancel after production has started, no refunds will be issued for any fees paid up to that point, due to the work already performed and costs incurred.

4. Disputes

If you are unsatisfied with the final deliverables, please contact us within 7 days of delivery. We will make reasonable efforts to address your concerns or provide revisions if outlined in your contract. However, dissatisfaction with the creative outcome alone does not warrant a refund, given the subjective nature of creative work.

5. Amendments to Refund Policy

Red Bird Studios LLC reserves the right to modify or update this Refund Policy at any time. Any changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
